Herbert FISCHER, born on March 14th, 1918 in Vienna/Austria (entitled residency ("heimatberechtigt") for Vienna/Austria, citizenship 1938: Austria), son of Oberlandesgerichtsrat Dr.jur. Otto Fischer (senior law official), lived in Vienna's 19th district, Billrothstraße 6a, was enrolled finally in the spring term of 1938 at the Law School in the 2nd year of his studies.
He was an Old Catholic, but after the "Anschluss" in 1938 he was considered a "Mischling 1. Grades" for racist reasons and could only continue his studies provisionally - subject to revocation at any time. He was still able to pass the first state examination with distinction in 1938 and was then drafted into the German Wehrmacht for military service, enlisted in Bohemia/Moravia, fought in the Polish campaign, in Belgium and in France and was wounded near Lacan/France on May 22nd, 1940 and discharged from military service on December 20th, 1940, as "Mischling 1. Grades" were no longer permitted in the Wehrmacht for racist reasons.
He then attempted to resume his studies, which had been interrupted in 1938, and - like all "Mischlinge" from 1940 onwards - had to submit a personal application to the Reich Ministry of Education in Berlin in order to be admitted to continue his studies. The application dated January 16th, 1941 was approved by the dean's office and the student leadership. A student personnel file from 1941 contains a further application to the Rectorate of the University of Vienna dated February 15th, 1941, asking whether he could enrol conditionally until the decision from Berlin, which was approved immediately. The enclosed photograph shows him in Wehrmacht uniform. An enclosed section from the bursar's office with confirmation of paid tuition fees dated May 1st, 1942 is presumably related to his doctorate, which was awarded on September 19th, 1942 (without the usual remark "Mischling 1. Grades" in the graduation registry). The title of his dissertation was: "The Theft in the People's Rights".
Little is known about his further life and career.
